What Is The Process For Divorce?

In April 2022, the ‘no-fault divorce’ was introduced. Applicable to both marriages and civil partnerships, the no-fault divorce laws allow couples to separate without apportioning blame. Instead, they must confirm that their relationship has irretrievably broken down.

The steps a couple must follow to obtain a divorce are as follows:

• File For Divorce.

Either party can apply for a divorce of their own accord, or the couple can apply jointly. You must have been married or in a civil partnership for at least 12 months before making a divorce application.

• Respond To The Divorce Application.

Where your spouse or civil partner applies for a divorce without you, you will receive a copy of their application. You must acknowledge receipt of the application within 14 days. You can only dispute the divorce in extremely limited circumstances, for example where you want to dispute the English Court’s jurisdiction.

• Cooling-Off Period

Following the divorce application, you cannot take any further steps in the divorce process for 20 weeks. Known as the ‘cooling-off period’, the parties are expected to use this time to explore the possibility of a reconciliation or to discuss how they might settle the issues arising from their separation, such as how their assets should be divided.

• Apply For A Conditional Order

Once the cooling-off period has expired, you can apply to the Court for a ‘Conditional Order’. A Conditional Order does not legally end your marriage. It merely confirms that you are eligible for a divorce.

• Apply For A Final Order.

At least six weeks after the Court grants your Conditional Order, you can apply for a Final Order. Once the Final Order is granted, your marriage or civil partnership is at an end.
